During our last race, this happened to me twice by the same boat. Even after doing the penalty turns they passed us going down wind and won the race anyway. Anyway, during a crossing, while I was on starboard tack approaching the port tacker, they tacked over right in front of me. I had to luff up to avoid them. So as I read it, as soon as the port tacker has tacked over and her sails have filled, she now has the right of way over the boat astern? So if I luffed up before her sails have filled, the port tacker has a penalty, if after her sails have filled, then there is no foul?
13 WHILE TACKING
After a boat passes head to wind, she shall keep clear of other boats until she is on a close-hauled course. During that time rules 10, 11 and 12 do not apply. If two boats are subject to this rule at the same time, the one on the other’s port side or the one astern shall keep clear.
