The relevant part of the rule is the first part - after a boat passes head to wind, she shall keep clear... If you had to luff up to avoid a collision, then they tacked too close. Note that the distance required varies with the conditions - big breeze and waves make the situation more critical, while in light air one can cut it much closer.
